Terms and Conditions

PRICING: All pricing is subject to change without notice.

TERMS: The Buyer must follow through with all Deposits required to secure the grapevines requested. Vines are available in limited quantities and are not confirmed until the required deposits are received along with a signed copy of the estimate. Estimates are only valid for 30 days. FINAL ORDER AVAILABILITY IS SUBJECT TO NUSERY YIELDS.

The balance of the total invoice is always due upon receipt of the vines, unless otherwise indicated on the invoice. Over due accounts are subject to a service charge of 2% per month to a maximum of 24% per annum.

Deposits are non-refundable. If the Buyer cancels all or part of an order confirmed with a deposit, the deposits paid shall be forfeited with no further obligation on the part of Gemmrich W. Nursery Inc.

GUARANTEE: Our vines are guaranteed to be:

True to their name both in variety and rootstock.
Cautiously grown and free from harmful insect damage and disease.
Properly graded for quality and uniformity.
Carefully stored to maintain the highest quality.
Carefully packed in suitable containers to arrive in the best possible condition.
Guaranteed to grow if correctly planted, cared for and maintained upon receipt

We guarantee to replace vines which do not grow under our conditions and at our discretion, providing we are notified directly of your loss by September 1 of the same year planted, at our discretion only. After September 1 we will credit the amount to ½ of the purchase price on plants which fail to grow in the first growing season or credit your account equal to ½ of the purchase price, at our discretion only on the following conditions:

1. All accounts must be paid in full by due date

2. Notice of vines that did not grow must be given by September 1 (Quantity and Variety)

3. The purchasers agree to assume the responsibility for proper care and maintenance of their vines. This means they will:

Carefully protect and store them until planting.
Plant them properly in suitable soil on a correctly prepared site.
Plant them in an adequate soil opening to accommodate the root system and tamp them in.
Water vines as is necessary.
Cultivate to protect vines and prevent competition from grass and weeds.

4. This guarantee is valid on regular priced plants only. No guarantee, replacement or refund will be given on plants sold on sales, specials or discounted prices unless stated on the invoice and signed by an authorized person within the company.

5. Claims must be made within 5 days after receipt of goods

6. If any nursery stock does not prove to be true in both variety and rootstock under which it was sold. We will, with proper proof, replace or refund the original amount paid.

7. Under no circumstances will Gemmrich W. Nursery Inc. be liable for any amount greater than the cost of vines that did not grow.

YOUR GUARANTEE IS NULL AND VOID IF PROPER CARE IS NOT TAKEN TO PROTECT VINES FROM WIND, COLD OR SUN WHILE TRANSPORTING, OR IF COMMERCIAL FERTILIZER, MANURE, OR ANY OTHER SIMILAR ITEMS ARE USED DURING THE PLANTING PROCESS.

This guarantee is also subject to “Acts of God”, and is made contingent upon strikes, accidents, weather conditions, performance of plant material (scion wood/rootstock), fire, regulations imposed by government agencies, or other delays beyond the control of the parties affecting Gemmrich W. Nursery Inc. operation.

CLAIMS: Claims must be made in writing within 5 days after receiving goods. Counting vines is the responsibility of the person picking up the vines and Gemmrich W. Nursery Inc. will not be responsible for shortages after vines have left the property

SHIPPING: It is the responsibility of the purchaser to provide full shipping directions with each order. All orders are to be paid in full prior to delivery, including all packaging charges. Shipments may be charged collect.

Packaging Charges: Packaging charges may be applicable to boxed or bundled orders.

IMPORTED GRAPEVINES: Imported vines are subject to CFIA (Canadian Food inspection Agency) regulations including Hot Water Treatment. Gemmrich W. Nursery Inc. is not responsible for implications associated with these.
